WatsKrakin is a lounge for artists to meet entertainment companies through video profiles. The video profiles are created on the site by uploading videos. Before uploading the videos please read the terms and conditions carefully. If you do not agree to the terms and conditions of this video hosting service please do not upload videos. 1. Participation and Good Citizenship: You have to comply with this agreement in-order to participate in this site. We reserve the right to refuse participation to any applicant or participant at any time In our sole discretion, and to withdraw content, suspend, terminate the services provided under this Agreement and your participation in the site, immediately without notice to you and without liability to WatsKrakin, for reasons, including violations of uploading copyright ed materiel and other types of offensive or content of pornographic nature. This is not a video sharing site, non-audition and non-art related materiel would be deleted without notifying you. You are responsible for keeping your contact information updated. You are also responsible of maintaining the “Good Citizenship”, by not engaging in any of the following activities: spamming, flooding, rude and obscene comments, postings of copyrighted materials. WatsKrakin reserves the right to determine the nature of the activity and make decisions. |
2. Your Content: You are hereby designating content for hosting and display to end users by uploading such content directly to WatsKrakin. By uploading to WatsKrakin you are granting WatsKrakin a royalty-free, non-exclusive right and license to, host, cache, route, transmit, store, copy, modify, distribute, perform, display, reformat, excerpt, analyze and host on WatsKrakin servers. This license gives WatsKrakin the right to display your content via streaming and/or downloading technologies to the end user. WatsKrakin reserves the right to display advertisements in connection with your content. WatsKrakin is not responsible for any loss, theft, intellectual property infringement or for damage of any kind to your content.

3. Your Personal Information: By uploading and participating in this program you are agreeing to provide your information during registration to entertainment companies. By setting or pointing the location on the Map you are revealing your current or previous location information. This information is provided at your own will and WatsKrakin is not responsible or liable of protecting the location information and it’s displayed to all users of the system. To increase privacy your may not choose to set your location information during registration or during video upload. You agree that WatsKrakin may transfer and disclose this information, including personally identifiable information, to third parties for the purpose of approving and enabling your participation in the Program, including to third parties that reside in jurisdictions with less restrictive data laws than Your own. WatsKrakin may provide any of the above information in response to valid legal processes, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims. |
4. Copyrighted Material: You are hereby agreeing to upload material owned by you. If you do not own the copyright to the material please do not use this upload service. WatsKrakin will remove copyrighted or plagiarized materials, if notified by the appropriate authorities without your consent. WatsKrakin is not responsible for the uploaded materials and will disclose your information to the appropriate authorities in such situation

This Agreement shall be construed as if jointly drafted by the parties. This Agreement shall be governed by the laws of the State of California, without regard to its principles of conflicts of law. Any litigation hereunder shall be brought in any state or federal court of competent jurisdiction in Santa Clara County, California; the parties agree that venue shall be proper in, and consent to the personal jurisdiction of, such courts. The parties specifically exclude from application to the Agreement the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act. The provisions of Sections 1-4 shall survive any expiration or termination of this Agreement.
